TERMS AND CONDITIONS – HOME INSPECTION COST CONTRIBUTION

The following Terms and Conditions govern any contribution toward home inspection costs offered by Jason T Fowler, Century 21 Affiliated (Wisconsin Real Estate License No. 57590-90) (“Agent”).

  1. Nature of Contribution
    Any contribution toward home inspection costs is offered solely as a discretionary incentive or gesture of goodwill and does not constitute a rebate, inducement, or guarantee of any kind. No client is entitled to such contribution, and the Agent retains sole discretion as to whether and under what circumstances it is provided.
  2. Eligibility and Limits
    This program is limited to the first twenty-one (21) clients in calendar year 2026 who successfully purchase or sell real property using the Agent. The maximum contribution shall not exceedFive Hundred Twenty-Five Dollars ($525.00) per transaction. Payment, if made, shall be paid directly to the licensed home inspector selected by the client.
  3. Inspection Timing and Purpose
    • Buyers who elect not to include a home inspection contingency in an Offer to Purchase may, at their option, use the contribution toward an inspection conducted after closing.
    • Sellers may apply the contribution toward a pre-listing inspection.
      The client understands that inspections performed after closing or for pre-listing purposes may not provide the same legal protections as inspections conducted pursuant to an inspection contingency under Wisconsin law.
  4. No Endorsement or Responsibility for Inspectors
    The Agent does not select, supervise, warrant, or guarantee the work of any home inspector. The Agent makes no representations or warranties regarding the inspector’s qualifications, performance, findings, or omissions. The inspector is an independent third party, and all inspection services are governed solely by the agreement between the client and the inspector.
  5. Limitation of Liability
    To the fullest extent permitted under Wisconsin law, the Agent shall not be liable for any loss, damage, injury, cost, or expense arising out of or related to the inspection, the inspector’s services, or reliance on any inspection report, whether or not a contribution toward the inspection cost was provided.
  6. Modification or Revocation
    The Agent reserves the right to modify, suspend, or revoke this contribution program at any time, with or without notice, and without liability, except with respect to contributions already paid.
  7. Tax Considerations
    The Agent does not provide tax advice and makes no representations regarding the tax treatment of any contribution. Clients are solely responsible for any tax consequences and are encouraged to consult a qualified tax professional.
  8. Release and Hold Harmless
    By accepting any contribution, the client agrees to release, indemnify, defend, and hold harmless the Agent and Century 21 Affiliated from any and all claims, damages, liabilities, or causes of action arising out of or related to the inspection, the inspector’s services, or participation in this program.
  9. Acknowledgment
    By accepting the contribution, the client acknowledges that they have read, understand, and voluntarily agree to these Terms and Conditions and assume all risks associated with the inspection and the real estate transaction.
